By downloading, installing, or using My BP Diary ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a binding legal agreement between you ("User") and the independent individual developer ("Developer") of My BP Diary. The Developer reserves the right to modify these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
My BP Diary is a personal record-keeping tool only. It is not a medical device, and the information it provides does not constitute medical advice, diagnosis, or treatment.
The Developer expressly disclaims all legal liability for any health issues resulting from data entry errors, misuse of the App, or reliance on data recorded or displayed in this App.
My BP Diary is licensed to you for personal, non-commercial use only. You may use the App to:

πΎ Local, iCloud & System Health Data
All health data you enter is stored on your device (via Apple SwiftData or Jetpack Room DB) and optionally synced to iCloud (via Apple CloudKit on iOS) or written to Apple Health (HealthKit) or Android Health Connect. You are solely responsible for the backup, accuracy, and security of this data.

When you enable Apple Health or Android Health Connect integration, your measurements are written directly to the respective system health app database. The storage, security, and backup of this data are managed entirely by Apple or Google's system infrastructure. The Developer assumes no responsibility or liability for any data loss, synchronization discrepancies, permission resets, or manual deletions occurring within Apple Health or Android Health Connect.
β οΈ Data Loss Disclaimer
The Developer is not responsible for any loss of data caused by device failure, iOS or Android updates, iCloud outages, Google Account backup failures, or accidental deletion. The Developer strongly recommends maintaining independent backups of important health records with your healthcare provider.
The Developer is technically incapable of accessing, recovering, or restoring your data, as it is stored exclusively within your device and Apple/Google's secure infrastructure.
My BP Diary offers optional in-app purchases including:
All transactions are processed by Apple's App Store payment infrastructure or Google Play Billing. The Developer has no access to your payment details. Refund requests must be submitted directly to Apple through reportaproblem.apple.com (on iOS) or Google Play through your Google Account purchase history (on Android).
All in-app purchases and your use of the App are governed by the standard Apple End User License Agreement (EULA) or the Google Play Terms of Service / standard Android EULA.
All purchases are final once processed, subject to platform refund policies. The "Buy Me a Coffee" purchases are voluntary donations and are non-refundable by the Developer.
All content, design, code, graphics, and other materials in My BP Diary are the exclusive intellectual property of the Developer and are protected by applicable copyright and intellectual property laws.
Nothing in these Terms grants you any right, title, or interest in or to the App's intellectual property beyond the limited license to use the App as described herein.
π To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of data, health incidents, personal injury, or financial loss arising from your use of or inability to use this App.
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
In jurisdictions that do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages, the Developer's liability shall be limited to the fullest extent permitted by law.
The Developer reserves the right to modify these Terms at any time. Material changes will be indicated by an updated Effective Date at the top of this document. Continued use of the App after the effective date of revised Terms constitutes your acceptance.
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the competent courts in the Developer's jurisdiction.
